Judiciary Act 1903 - It did not establish the High Court but prescribed certain matters relating to its jurisdiction and procedure. The High Court was established by the Australian Constitution (which was itself established under the Commonwealth of Australia Constitution Act 1900 of Her Majesty's Imperial Parliament). [edit]- Actually that was one of the questions in this case, and the issue has not (to the best of my knowledge) ever been decided. It seems likely that the court at least derives its authority from the Constitution, but whether the court existed before the Judiciary Act is still an open question. The court did celebrate their own centenary in 2003. --bainer (talk) 06:21, 8 October 2005 (UTC)
